PART VII - INTERDICTION AND SUSPENSION




Regulation 46. Interdiction for the purpose of investigation.

(1) Without prejudice to regulations 28 and 47, if an officer is alleged or reasonable suspected of having committed a criminal offence or a serious disciplinary offence, the appropriate Disciplinary Committee having the jurisdiction to impose a punishment of dismissal or reduction in rank on such officer may interdict the officer for a period not exceeding two months for the purpose of facilitating investigation against the officer.

(2) In deciding whether to interdict an officer under subregulation (1), the appropriate Disciplinary Committee shall take into account the following factors:
(3) If, during the period an officer is under interdiction—
the interdiction order made under subregulation (1) shall cease to have effect from the date such criminal proceedings are instituted or disciplinary action is taken gainst the officer; and the appropriate Disciplinary Committee shall take such further action as it thinks fit under regulation 47.

(4) An officer who has been interdicted under this regulation shall be entitled to receive full emoluments during the period of his interdiction.
